Privacy Policy – Executive Summary

  • We do not collect personally identifiable information about you unless you provide it to Us directly.

  • All information collected by Us is for the effective functioning of Our Games only. It will never be sold or shared.

  • Our PC and Console Games contain no advertising. They do not use advertising networks, advertising identifiers or mobile analytics.

  • Our Mobile Games do use third-party advertising partners, who collect information so that advertisements can be served. Links to those partners and their privacy policies can be found below.

  • We only retain collected information while it remains in use. Once it is no longer in use it is deleted promptly. The maximum period of time We would hold information is 5 years.

  • Our Games use Amazon Web Services, an international cloud service, to store data critical to the function of the Game. Therefore, your data will be stored on servers outside of Korea.


Featherweight Games Pty Ltd (Australian Business Number: 69 605 061 970) (defined here as ‘We’, ‘Us’ or ‘Our’) recognise the importance of your privacy and understand the concerns surrounding security of personal information.

This Privacy Policy sets out how We collect, use and disclose “personal information” and other “non-personal information” We have gathered about you in relation to all of the games We develop and publish, including all versions and ports on any platform (each a “Game” and together Our “Games”), and Our website: https://www.featherweightgames.com.

By playing and interacting with Our Games, you acknowledge and consent to the terms of this privacy policy.

This policy will let you know:

  • What information (often referred to as ‘data’) is collected from you;

  • How your information is used;

  • With whom your information may be shared;

  • Where your information is stored and located; and

  • How you can access, update, or delete your information.

We will comply with all relevant and applicable legislative requirements, and, in the event of any inconsistency, the legislative requirements will override the provisions of this document.

Our Games, and Which Parts of This Policy Apply to You

We develop and publish games on two different kinds of platform. The data collected differs significantly between them, and this policy distinguishes between them throughout. In this policy:

  • Mobile Games means Our games released on mobile platforms, including through the Apple App Store and Google Play; and

  • PC and Console Games means Our games released on personal computer and games console platforms, including Chained Beasts.

Advertising, advertising identifiers and mobile analytics are used only in Our Mobile Games. They are not used in Our PC and Console Games. In relation to Our PC and Console Games:

  • We do not display advertising of any kind;

  • We do not integrate any advertising network, advertising mediation platform, ad server or advertising software development kit (SDK);

  • We do not collect, use, store or transmit mobile advertising identifiers, including the Apple Identifier for Advertisers (IDFA), the Google Advertising ID (GAID / AAID), MAC addresses or IMEI numbers;

  • We do not integrate mobile analytics, attribution or install-tracking SDKs; and

  • We do not undertake interest-based, behavioural or cross-application tracking, and We do not build advertising or marketing profiles about you.

Where a section of this policy applies only to Our Mobile Games, or only to Our PC and Console Games, it says so. Where a section does not say so, it applies to all of Our Games.

Not every third-party service listed in this policy is used in every Game. Where a Game uses a service which is not listed in this policy, We will update this policy before or at the time of that Game’s release.

User Age Limits

Our Games are not aimed at children under 13 years of age. Nevertheless, We acknowledge that Our Games may unintentionally appeal to children.

We do not collect children’s data specifically, and We do not collect personally identifiable information within Our Games for children. In Our Mobile Games, We limit Our data collection and only use persistent identifiers to support the internal operations of those games. We do not direct interest-based or behaviourally targeted advertising to anyone under the age of 13 years, and Our PC and Console Games contain no advertising at all.

If you believe that We have inadvertently collected information from a person under the age of 13, please contact Us at the email address below and the information will be permanently deleted.

What data do we collect?

We collect data in three ways.

  1. Data collected automatically;

  2. Data you provide us; and

  3. Data collected by our third-party partners.

The basis for collecting data is “legitimate interest” under GDPR (General Data Protection Regulation) and “to support internal operations of the game” under COPPA (Children’s Online Privacy Protection Act). Any data collected is done solely for internal uses that are reasonably and directly related to your relationship with Us, in accordance with the California Consumer Privacy Act (CCPA).

We may collect two types of information that relate to you, namely, ‘personal information’ and ‘non-personal information’.

Personal information is information that identifies you as an individual (“Personal Information”). Personal Information is only collected by Us if you submit it to Us directly. We note that this does not mean that Our Games themselves do not collect data, rather that We do not collect personal information from you unless you provide it to Us directly.

Please note that we do not sell your Personal Information to anyone.

Collection of ‘Non-Personal’ Information

Non-personal information is information that does not identify, distinguish or trace you (or your device) (“Non-Personal Information”).

Some Non-Personal Information may be gathered while you use Our Games. Non-Personal Information is general, non-identifiable and anonymous information that is gathered for statistical, analytical and research purposes such as the improvement of Our Games (for example, bug fixes).

Sometimes if Personal Information and Non-Personal Information are collected and read together, the Non-Personal Information may become identifiable information. Additionally, sometimes data that doesn’t appear to be personal can become personal if certain other facts are learned.

What about Sensitive Information?

Sensitive information includes information about such things as an individual’s racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a professional body, criminal records or health information.

We will not attempt to obtain nor record any sensitive information.

How do we use the data we collect?

We may collect and use your information in order to deliver the services you request, manage your account settings, and help safeguard against unauthorised use. We also use it to keep you informed about the services you use, respond to your support inquiries, share updates or relevant offers, invite feedback, and notify you of changes to our policies. This information helps us gain insights into user preferences and improve Our Games and services.

No matter how We come to collect or have access to your data, We will always treat it in accordance with this policy, and any applicable legislation.

A. Data collected automatically

Certain data is collected automatically. In relation to all of Our Games, this includes:

  • Data about your usage (and activity) within the Game;

  • Data about your Game progress;

  • Data about your device, such as device model, operating system, hardware configuration and language settings;

  • Data about your interaction with the Game, such as gameplay data; and

  • Your IP address, which is used to derive your approximate (country-level) location.

In Our Mobile Games only, We additionally collect:

  • Your device identification number and other persistent identifiers, used to support the internal operations of the game; and

  • Your mobile advertising identifier (IDFA or GAID / AAID), where you have not opted out of personalised advertising at the device level.

In Our PC and Console Games only, We additionally collect:

  • Where you play while signed in to a platform account, the identifier and public profile information made available to Us by that platform (for example, your Steam ID and persona name, PlayStation Network Online ID, Nintendo Account nickname, or Xbox gamertag).

Our PC and Console Games do not generate, collect or transmit an advertising identifier, MAC address or IMEI.

B. Data you provide us

Direct Marketing, Newsletters Mail-Outs and Promotional Materials

When you ‘opt in’ to join our mailing list for the purpose of receiving our newsletters, direct marketing and other promotional materials relating to Our Games and services, including but not limited to related offers, promotions, news, events and other relevant information (“Marketing Communications”), we will use the information you supply to provide you with Marketing Communications. If you wish to receive Marketing Communications from us, you will be asked to provide your name and email address to us.

Please note that when you elect to ‘opt in’ to receive Marketing Communications from us, your information is processed by a third-party partner that collects and compiles that information for us, so that we may undertake mail outs to large numbers of people. How you can ‘opt-out’ from receiving Marketing Communications from us

You may unsubscribe from our mailing list at any time. All you need to do to unsubscribe is click the ‘unsubscribe link’ in the Marketing Communications sent to you, or let us know in writing, via emailing us at privacy@featherweightgames.com that you want to be removed.

End-User Feedback, Customer Support and Communications

If you contact Us with a comment or query, or send Us a message through Our support system, We keep a copy of any personal information you provide in such communication. This is so that We can respond to your comments, feedback, crash reports and questions, as a part of Our commitment to providing you with end-user support. If you contact Us directly for any reason, We also keep a copy of that correspondence.

We will also keep your contact details if you contact Us for another purpose.

We collect and store your email address where you nominate to specifically allow Our Games to collect your player name and your email address.

C. Data we collect from our third-party partners

To operate and manage Our Games, We need to use third party service providers from time to time. A list of those parties can be found in this privacy policy. The type of information We might collect from them includes:

  • Demographic data (to determine the coarse location of your IP address);

  • Game behaviour data; and

  • Data for analytics purposes.

Third Party Service Providers

Apart from Us, your data may be accessible by Our third-party providers in the following circumstances. Our Games include services from third-party providers such as functionalities through application programming interfaces (APIs), Software Development Kits (SDKs) and other related services. These third-party providers may access your data and operate under their own privacy policies. We encourage you to review their privacy policies (listed below) before interacting with Our Games. We do not control how they interact with you, and you should ensure that you consent to their terms of use and privacy policies before providing them with, or giving them access to, your Personal Information.

Third-party partners used in Our PC and Console Games

Where you play one of Our PC and Console Games on a platform such as Steam, the PlayStation Network, Nintendo Switch Online or the Xbox network, that platform holder collects and handles information about your account and your use of that platform in its own right, and as a separate controller of that information. Your relationship with the platform holder is governed by that platform holder’s own terms of service and privacy policy, and not by this policy.

Third-party partners used in Our Mobile Games

The following advertising, attribution and analytics partners are used in Our Mobile Games only. They are not integrated into, and receive no information from, Our PC and Console Games.

Analytics

In order to operate and improve Our Games, and for internal statistical, analytical and research purposes, Our Games collect limited information about how end-users interact with them – for example, session length, which parts of a Game are played, and where errors occur (“Analytics Data”).

In Our PC and Console Games, We use Aptabase. Aptabase is a privacy-focused analytics service. It does not use cookies, does not collect or store an advertising identifier or a persistent device identifier, and does not track you across other games, applications or websites. Your IP address is used only to derive your approximate (country-level) location and is not retained. We do not receive, and cannot derive, information which identifies you as an individual from Analytics Data collected in these Games. In Our Mobile Games, We use the analytics and attribution partners listed above. Analytics Data collected in those Games may be associated with a persistent device identifier, and is handled in accordance with those partners’ privacy policies.

Storage of Data

Data Stored outside of Korea

Our games use international cloud services for the storage of data via Amazon Web Services (aws-korea-privacy@amazon.com), and Google’s Firebase. To the extent data is collected, your data will be captured and stored by these cloud services, which are based outside of Korea. This is done via real-time database synchronisation on a case-by-case basis. If you do not consent to your data being treated this way, you cannot use our service. This information will never be sold or shared and will be deleted securely and promptly when no longer in use.

Transfer of personal information overseas

Your personal information may be transferred overseas in accordance with the following table:

International Transfers of Your Information

Given that Our Games are globally accessible, there are times where your data may need to be transferred across different jurisdictions. However, we will not transfer your personal information across jurisdictions, unless:

  • You have provided your consent; or

  • It is necessary to complete a transaction in Our Games; and

  • We believe that the recipient of such information is subject to a law, or a binding scheme, that has the effect of protecting your information in a way that, overall, is at least substantially similar to the way in which the Australian Privacy Principles (APPs) protect information; and there are mechanisms you can access to take action to enforce that protection of the law or binding scheme; or

  • Where otherwise allowed by any applicable legislation.

Retention and Destruction of Your Information

Retention Period

We retain your information only for as long as is necessary for the purposes set out in this policy, including to operate and support Our Games, to comply with Our legal obligations, to resolve disputes, and to enforce Our agreements. In practice:

  • Analytics Data is retained in aggregate form for 5 years, in line with the retention period applied by Aptabase;

  • Correspondence with Our support channels, and any Personal Information contained in it, is retained for 5 years after the matter to which it relates is resolved;

  • If you have opted in to receive Marketing Communications, We retain your name and email address until you unsubscribe, and for a reasonable period afterwards in order to record and give effect to your unsubscribe request; and

  • Save data, progress, achievements and account information held by a platform holder are retained in accordance with that platform holder’s own policies and retention periods, and not by Us.

When your personal information is no longer necessary, that is, upon the retention period passing and the purpose of its collection having been achieved, We will destroy the personal information. We note that after 3 years, all other data not subject to a retention period will be permanently deleted.

Personal information must be kept for a specific and certain period of time as outlined by relevant laws and regulations noted below.

Destruction of personal information

The destruction of personal information occurs as follows.

Procedures:

  • Retention period and purpose achieved: the personal information which requires destruction is identified and then destroyed; and

  • Your request: upon your request and instruction, We will permanently delete all personal information stored by Us.

Method:

We will destroy your personal information that is stored digitally, that is, in an electronic format, so that no further records can be reproduced. In the case of physical information, such as printed records, materials and documents, a shredding device will be used for destruction.

Access, Deletion and Correction of Your Personal Information

Regardless of how We may come in contact with your data, you have the right to request access to any Personal Information We hold about you. You may request access to the information We hold about you by contacting Us via email at privacy@featherweightgames.com. If at any time you believe that personal information about you is incorrect, incomplete or inaccurate, you may request that We amend such information. If We refuse your request, We will provide you a written notice which outlines the reasons for such refusal and the complaint mechanisms available to you.

You may also request that We delete any Personal Information We hold about you by contacting Us via email at privacy@featherweightgames.com.

Data Subject Requests

In the event that you send a data subject request to Us, or one of Our third-party partners informs Us that you have contacted them directly about your personal data they collected while you were using Our Games, We will respond to that request in accordance with any applicable legislation.

If you wish to know what data We hold about you, if any, please make out your request to Us in writing at the address listed below. Please be aware that in order to protect the information in Our database, We will require identification from you before releasing any information.

Disclosure and Security of Your Information

We will not sell, trade, rent or disclose any of the personal information you provide to us for any reason, without your prior consent. Otherwise, your Personal Information will only be disclosed where required or allowable by law.

Your Personal Information is stored offsite in a manner that reasonably protects it from misuse, loss, unauthorised access, modification or disclosure.
